SBF rút lại đơn xin xét xử lại, cho rằng không thể nhận được một phiên tòa công bằng từ thẩm phán
SBF đã viết thư cho Thẩm phán Lewis Kaplan ở New York, thông báo về việc tạm thời rút lại đơn xin xét xử lại theo Quy tắc 33. SBF cho biết rằng ông cần tập trung vào việc trả lời câu hỏi của thẩm phán về việc liệu các luật sư của ông có tham gia vào việc soạn thảo đơn hay không, và ông tin rằng ông không thể nhận được một phiên tòa công bằng trước thẩm phán đó, vì vậy ông đã quyết định rút lại đơn xin. Ông dự định giữ quyền được nộp lại đơn sau khi có phán quyết về đơn kháng cáo trực tiếp và yêu cầu liên quan đến việc phân công lại thẩm phán.
Trước đó, SBF đã bị tuyên án 25 năm tù vì lừa đảo khách hàng và nhà đầu tư. Trong thư của mình, ông xác nhận rằng đơn xin chủ yếu được hoàn thành thông qua nghiên cứu và soạn thảo pháp lý độc lập của ông trong khi ở trong tù tại Brooklyn, với cha mẹ của ông chỉ cung cấp các gợi ý biên tập và hỗ trợ in ấn.
